James T. Morehead, attorney, petitioned the court saying that there are some 21 - 22 slaves which will have to be sold for the payment of debts and must be sold by July to avoid any sacrifice. The judge must order the slaves to be sold. 325

1846 Dec - Stokes Co., NC - Estate Setttlement of Joshua Banner:
Ex Parte to Edwin H. Banner to sell the slaves. It is ordered by the court that Reuben B. Golding, Trane Gibson and Marshall T. Benton be appointed commissioners to settle and report the term of Edwin H. Banner Adminstrator of Joshua Banner deceased estate and that in settlement the adminstrator be allowed 5 per cent commissions on the debit side and 21/2 cent on the credit side of account. Approved on the minutes, It is ordered by the court that Henry B. Lehman and William Gopling be appointed commissioners to settle with George F. Wilson and Zachariah Wall and wife Betsy, adminstrators with the will answer of Leonard Ziglar deceased and that they report to the May term of court. It is further ordered that the commissioners be allowed 5 per cent on the debit side of the account and 21/2 per cent on the credit side. TO BE CONTROLLED. 325

1847 Jan - Stokes Co., NC - Estate Settlement of Joshua Banner:
Martha Banner’s widows yearly allowance. John G. Hill appoints freeholders James S. Green, Joseph Smith, Harrison Hartman, Solomon Petree, William Tuttle, Frederick Morris, Jesse Fry, Matthew Crews, Henry Baker, Lewis Morris, J. L. Gibson and Jeremiah Gibson to allot 1/3 of the 661 acres of land. Land is located on both sides of Buffalo Creek. Laid off 106 acres including the dwelling house and all the offices, out houses, buildings and improvements.The freeholders valued Martha’s 1/3 of Joshua’s property at $1,498.00 making the total value of his land at $4,494.00.
NOTE: Martha’s land was marked out for her as follows: Beginning at a STAKE at the ROAD thence running along the ROAD 48 poles to a stone thence south seventy degrees East 56 poles passing by TWO APPLE TREES to a DITCH thence south twelve degrees west along said DITCH 47 poles to BIRCHES on the NORTH BANK of the CREEK thence south eighty five degrees East 80 poles to the LANE near the BIG BARN thence south along said line twenty five degrees east passing through the GATE 10 poles to a STAKE thence north sixty six degrees east 40 poles to a BLACK OAK MARKED and thence north on a NEW LINE one hundred and sixteen poles to a small pine in GIBSON’S LINE west on the same168 poles to the BEGINNING containing 106 acres to be the same more or less.

Benton is as follows: 40 barrels of corn, 25 bushels of wheat, all the pork on hand, say about one thousand pounds, one cow and calf, one beef cow, all the sheep on hand, 12 head of hogs, two oak stacks,two hay stacks, three fodder stacks, all the shucks on hand, two bee stands, all the cotton and flax on hand, ten pounds wool robs and 4 bushels dried fruit and there being not sufficient of the crop. Stock and provisions on hand to make a comfortable year for the widow. Also $75.00 to be paid to the widow and family. 1854 Mar 12 -Forsyth Co., NC- Will of Martha Banner:
I, Martha Banner, of the county of Forsyth
and the State of North Carolina being of sound
and perfect mind and memory blessed be God
but weak in body, I do this twelfth day
of March in the year of our Lord, one thousand
eight hundred and fifty four, make and
publish this my last will and testament.
In manner and form following, that is to say,
after paying all my just debts, I give and bequeath
to my DAUGHTER MARTHA BREEDLOVE and her heirs,
the tract of land whereon I now live including
the mantion[mansion] house and all improvements
thereon, containing Sixty-two acres. And I farther
give one bay mare, one wagon, one kettle, and
one walnut cupboard. Secondly, I give to my SON
M. R. BANNER one cow and one calf. Thirdly I give to
my DAUGHTER MARY B.CREWS one bed and
furniture,and one brass kettle. Fourthly I desire
that my negro man, Sam be sold together with
the balance of my property, to the highest bidder
on a credit of nine months, for the purpose of
paying my debts, and if there should be a surplus,
I wish it to be divided between ANTHONY E. BANNER,
JOSHUA D. BANNER, JOHN W. BANNER, MATTHEW R. BANNER,
LEWIS B. BANNER, MARTIN L. BANNER, EDWIN H. BANNER, and
MARY B. CREWS. Fiftly I appoint my
SON MATTHEW R. BANNER Executor of this my last will
and testament.
In witness whereof I the said Martha Banner have
to this my last will and testament set my hand and
seal this the day and date above written.
