Agreeable to an order of the
County Court aforesaid Issued at Decembr.
Term 1804 - directing and impowering us to alot off
to the Widdow Mary Davis so much of the crop
stock &c out of the estate of the late Nathaniel
Davis decd. as will be sufficient to Support the
said widdow & family for one year, pursuant
thereto we have aloted to her the following articles
(viz) 10 barrels of corn or thereabouts, a small quantity
of flax & cotton, 400lbs of pork & hogs lard, 16 head
of hogs, most of them being small, 5 head of Cattle
being the whole of the aforesaid articles belonging
to the aforesaid Estate, also we do allow her 21lbs of
Barr Iron, given under our hands & seals

The petition of of Sally Davis, Betsy Davis and
John Davis infants under the age of twenty one years by
their lawfull guardian who prefer this petition again
st Joseph Davis, David Flynt, John Davis[Jr.], Robert
Davis, Jane Davis, Sally Davis and Molly Flynt
widow - humbly shewth unto your worships
that John Davis departed this life some time in
1804 or thereabouts intestate that David Flynt
Joseph Davis and Elizabeth Davis took out letters of
adminstration upon the aforesaid estate and took
upon themselves the burthen[burden] of adminstrating the same
your petitoners shew that Elizabeth Davis one of the
adminstrators has since deceased that David Flynt
another of the administrators has removed from
this state that Joseph Davis is at this time the
only acting administrator - your petitioners shew
that the said Joseph Davis has remained into his pos

sesion the whole of the personal estate of his intestatey
and has made sale of the same in part only
the amount of which is as appears from the records
of this 1, 320 pounds, 4 shillings, 8 pence your petitioners charge that
there was a large amount of the personal estate
which was never sold by the adminstrators taht
exact amount of which is unknown to your petitioners
your petitioners shew that they are the lawful
heirs of Nathaniel Davis now deceased who was son
and heir of the intestate John and that they are
entitled by law to one eighth part of the aforesaid
estate your petitoners charge that the defendants

mentioned in this petition have combined toge
ther for the purpose of defrauding your petitioners out
of their share of the aforesaid estate and that the other
heirs have inferred to join is a petition against the
administrators for their distributive share of the
estate - that the administrators have referred
to pay over all or any part of the money coming
to them allthough ofter requested so to do - to the
end therefore that the several defendants above men

tioned and particularly the said Joseph Davis may
be compelled to answer to the several things charged
in this petition on their oath and that this court may be enabled to
decree to your petitioners what in equity may term right
may it please your worships to grant to your petitoners

The petition of John Davis[Jr.], Robert Davis by his next friend
Joseph Davis, Joseph Davis, Mary Flynt, Sally Davis
Jane Davis and Sally Davis infant Betsy
Davis infant and John C. Davis infants under the age
of twenty one years by their guardian Joseph Davis and
Mary Davis Humbly shews unto your worships that John
Davis departed this life some time in the year 1805[1804] sezied and pos-
sed of two tracts of land in the County of Stokes on Mudy Creek
containing three hundred and seven acres the courses of which may be seen
by reference to the died[deceased] which your petitioners pray may be made a

part of this petition and one tract containing 100 acres adjoining
Charles Vest & Jacob Helisbeck and the course of which will be more fully
see reference being had to the deed for the same which your petitioners
also pray may be make a part of this petition - Your petitioners
state they are heirs at law to the said John Davis [Sr.] deced.
and are now all tenants in common in the aforesaid tracts of
land and pray that your worships will appoint five free
holders agreeable to act of Assembly to lay off and designate
in equal proportions their respective shares to the aforesaid

according to law. Whereupon Joseph Wilson Esquire attorney at law moved
that a scire facias issue against her, which was ordered by the court.

Petition on distribution
Thomas T. Armstrong to whom this
cause was referred maketh Report as follows:
That it is stated in the Petition &
admitted in the answer that John Davis died
intestate, that Joseph Davis the Defendant
was adminstrator on his Estate, & that after
paying Debts due the decd. then still remains
in the hands of admnr. a balance to be directed
amongst the distributors of said intestate.
That in order the better to ascertain
the amount of the balance aforesaid due
has had to recourse to the records of this
court, in which it appears upon settlements
made with the court then remains in
the hands of the admnr. Joseph Davis the
defendant herein a balance of
1, 258 pounds, 7 shillings, 11 pence to be divided as aforesaid
That admitting the correctness of
the said answer respecting the Number
of legatees, then Plantiff will be entitled
to one nineth part of said balance which
will be 139 pounds, 16 shillings, 5 pence on which sum
he supposes Interest ought to be calculated

from March 1807 being two years from
the time administrator was granted
which being calculated up to this term
will be 36 pounds, 11 shillings which added to the
former sum of 139 pounds, 16 shilings, 5 pence will make a
total of 176 pounds, 16 shillings, 5 pence.
That it does not appear on
the records of the Settlement aforesaid that
Joseph Davis the Deft. hererin has ever been
allowed any Commissions, the therefore
supposes that a commission of five per cent
would be adaquate to his services which being
deducted from the last mentioned sum

will have in the hands of the said deft.

Be it remembered at county court
of Pleas & Quarter Sessions begin and
held in and for the County of Stokes at
the courthouse in Germanton on the
2nd Monday of March AD 1809. Mary
Davis Guardian to the orphans of
Nathaniel Davis decd. filed her petition
against Joseph Davis & others Adminstra
tors of John Davis, decd. for a distribution
of the Estate of said John Davis decd
which was continued until September Term
1809 when Joseph Davis one of the defendant
& acting administrator came & filed his answer
to the said petition whereupon the such way
referred to Thomas Armstrong to report
on the Petition & answer & the same being
continued from term to term untill
June Term 1811 the said Thomas Armstrong
made report thereon when the court did
confirm the said report in all respects except
so far as respects the interest which was
not allowed whereupon the plantiff
prayed & obtained an appeal to the next
Superior Court to held in Stokes County
on the third Monday after the fourth Monday

at Stokes County Court March Term AD 1805 guardians to Sally, Betsy,
and John C.[Clayton]Davis orphans of Nathaniel Davis decd. And whereas the said
guardians have failed to make settlement of their accounts according to
law. Whereupon Joseph Wilson Esquire attorney at law moved that a
scire facias issue against them, which was so ordered by the court.
You are therefore commanded to make known unto the said Mary
Davis and Joseph Davis that they appear at our next court County Court to
be held in Germanton on the second Monday in June next term &
there to show cause if any they have; why they failed to make a

In the name of God, Amen, I Martin Flynt
of Lincoln County and state of Tennessee
being weak in the body but perfect mind and
memory do constitute this my last will and
testamony in the manner and for following;
vis.
I give and bequeath to my beloved wife,
Elizabeth the house and land which I now
live on and all the negroes and stock of
every description during her natural life
or widowhood except each child is to have
a negro about the same age as they marry or

Research: John Clayton lived in Bethania Township on the old road[Great Wagon Road] leading from Oldtown[Bethabara] to Germanton. He had a log home on this land, which still stands today and predates 1816, possibly built by his father John Clayton/Charity Banner. This house was weatherboarded in 1860 and still stands today today. John Clayton's son, Matthew Columbus, farmed and lived in this house after Matthew returned from the Civil War. 360

Research: John Clayton lived in Bethania Township on the old road[Great Wagon Road] leading from Oldtown[Bethabara] to Germanton. He had a log home on this land, which still stands today and predates 1816, possibly built by his father John Clayton/Charity Banner. This house was weatherboarded in 1860 and still stands, today as an antique shop.
John Clayton's son, Matthew Columbus, farmed and lived in this house after Matthew returned from the Civil War.

On 30 Aug 1816 when John was 27, he married Elizabeth MOORE, daughter of Reuben MOORE & Mary Ann EDWARDS, in Stokes Co., NC. Born on 8 Feb 1796 in Stokes Co., NC. Elizabeth died in Forsyth Co., NC on 11 Dec 1858, she was 62. Buried in Clayton Family Graveyard.

They had the following children:

In 1865 when Elizabeth Jane was 42, she first married William W. TERRY, son of John TERRY & Amy VAUGHN, in Forsyth Co., NC. Born in 1805 in Stokes Co., NC. William W. died in Forsyth Co., NC in Sep 1879, he was 74.181

"In the name of God, Amen. I William W. Terry of the County of Forsyth
in the State of North Carolina, do make, publish, and declare the
following to be my last will and testatment; that is to say .
First, I will and devise to my beloved WIFE ELIZABETH J. TERRY[Elizabeth Clayton] for and during her natural life, one third part in value of all my
lands of which I may die seized and possessed, including my dwelling
house and improvements, and I do also will and devise to her the
twenty five one acre tract part of which is known as the Zimmerman
tract, this I give to her absolutely.
Secondly, I wll and bequeath to my said wife ELIZABETH J.
TERRY all the money that may be on hand and debts due me at
my death, my grey mare, all the milk cows that may be on
hand, two beds, bedsteads, and furniture, her choice, one bureau
and contents, her chains, one clothes press and contents, the watch
she got of her brother Gideon Clayton, three band boxes and
their contents, and a large family bible which she had when
we were married.
Thirdly, I will and direct that my executors hereinafter named,
as soon after my death as may be convenient present to sell
the whole of the land of which I may die seized and possessed
including the remainder after my said wife's third part for her
life, that the sale be made for cash, at public auction, upon the
premises, after due advertisement, and that the proceeds of said
sale be divided as follows, to wit: to my SON NATHANIEL R. TERRY
one fourth part, to my DAUGHTER LORETTA TUTTLE WIFE OF PETER H. TUTTLE

and the remaining fourth part, I will and bequeath to the FOUR
LIVING CHILDREN OF MY SON JOHN H. TERRY, decd., late of the state of
GEORGIA, and to the survivors or survivors of them.
Fourthly, I will and direct that my executors hereinafter
named, as soon after my death as may be convenient, sell
at public aution, for cash, the whole of my personal estate, not
herein before disposed of, and the proceeds of such sale to dispose
of as follows, to wit; pay to my SON NATHANIEL R. TERRY, one fourth part,
to my DAUGHTER LORETTA TUTTLE WIFE OF PETER H. TUTTLE one fourth part,
to my DAUGHTER SARAH TERRY one fourth part, and the remaining
fourth part thereof I give and bequeath to the four living
children of my son JOHN H. TERRY decd. of the State of Georgia,
and to the survivors or suvivors of them, bu should all of the
said four children of my said son John H. Terry died before arriving
at the age of twenty one years, then and in that case it is my will
that all I have bequeathed to them in his my last will and
testament, go to, and be paid over to my three children above
named, to wit: Nathaniel R. , Loretta, and Sarah, share and share
alike, and I do hereby will and direct that the whole of the
money arising under or by virtue of this my last will to the said four
children of my said deceased son John H. Terry, remain in the
hands of my son Nathaniel R. Terry during the minority--
of the said four children, and that he settle with, and pay over to
them each as they shall arrive at the age of twenty one years and
should they all die without either of them arriving at that
age, then that he divide the money as above directed.
And lastly, I do hereby constitute and appoint my beloved wife
Elizabeth J. Terry and my son Nathaniel R. Terry executrix and
executor of this my last will and testament. In witness whereof
I have hereunto set my hand and seal this 1st day of Aug AD 1873.

is the executor named therein.
Further, that the property of the said Wm. Terry
consisting of 2 cows, 12 calves, 8 or 10 hogs and pigs, Household & Kitchen furniture,
Farming tools, wagins, & 307 acres of land more or less
is worth about $2000.00 so far as can be ascertained at the date of this application; and that
Nath. R. Terry, Loretta Tuttle wife of Peter H. Tuttle
Sarah Wilson wife of Jo. Wilson, & the heirs at Law of
John H. Terry, decd.
are the parties entitled under said will to the said property.

Joseph Winston guardian of Ruth Clayton report the following amount of property. On 1 Jan 1818 a note in the hands of John G. Smith for the hire of a negro boy $84.00; money in the hands of F. J. Smith $38.80; cash received $5.28; buy a pair of shoes for boy Abraham at $1.31; same for self at $1.62. The total remaining in the hands of $125.80 the guardian submitted. On 4 Oct 1820 when Ruth was 22, she married Levi CLINKSCALES, son of William CLINKSCALES & Nancy COLBERT, in Stokes Co., NC. Born abt 1795 in Virginia. Levi died in Carroll Co., Mo. on 13 Feb 1839, he was 44.

They had the following children:
i. John William.

ii. Robert Harden.

iii. James Crayton.

iv. Nancy Jane.

On 27 Mar 1845 Nancy Jane married William WILCOXSON.

v. Ruth Sophia. Born on 23 Mar 1835. Ruth Sophia died on 23 Jan 1852, she was 16.

On 24 Feb 1852 when Ruth Sophia was 16, she married Litteton TULL.
